RANGENET operates a high speed connection to the Internet and offers
its network and computer facilities to RANGENET subscribers
for commercial and research uses. During normal usage of network resources,
subscribers may utilize portions of the Internet that restrict commercial
or other traffic as per Acceptable Use Policy. All RANGENET customers
must agree to abide by all Acceptable Use Policies for any networks that
they traverse, and they must always comply with local, state, and federal laws.
Your use of RANGENET construes acceptance of these
Terms and Conditions which supersede all previous representations, understandings,
or agreements, and they shall prevail not withstanding any variance with terms
and conditions of any order. RANGENET reserves the right to modify these
Terms & Conditions and change pricing or services at any time without
notice.
DISCLAIMER OF LIABILITY:
RANGENET exercises no
control what-so-ever over the content of the information passing through
its networks. RANGENET makes no warranties of any kind, whether expressed
or implied, as to the availability, accuracy, or content of the information,
products, or services it is providing. RANGENET disclaims any warranty of merchantability
or fitness for a particular purpose. RANGENET is not responsible for any
damage suffered from the direct or indirect use of its services. This includes,
but is not limited to: expenses and loss of data resulting from delays,
nondeliveries, misdeliveries, or service interruptions caused by its own
negligence or errors or omissions. Use of any information obtained via
RANGENET is at your own risk. RANGENET specifically denies any responsibility
for the accuracy or quality of information obtained through its services.
RANGENET does highly encourage the use of filters for screening out information.
RESTRICTIONS:
RANGENET may only be used for lawful
purposes. Transmission or storage of material in violation of federal,
state or local regulation is prohibited. This includes, but is not limited
to material that is: copyrighted, judged to be threatening, compromises
security or privacy, or is protected by trade secret. RANGENET reserves
the right to remove or modify, at its discretion, any material in violation
of these policies. You agree to comply with the rules and restrictions
appropriate to other networks or services connected directly or indirectly
to RANGENET. This includes, but is not limited to the Acceptable Use Policies
established for Usenet and the Internet as a whole which expressly prohibits
commercial solicitation. You agree to indemnify and hold harmless RANGENET
from any claims resulting from your conduct and/or use of the service which
damages you or another party. RANGENET prohibits access to its system via
bulletin boards!
RESTRICTIONS WEB EMAIL:
Our web email policy is as follows:
-Users are not allowed to send to more than 50 recipients at a time.
-Users are not allowed to send more than 50 total emails in a 24 hour period.
Additionally, users will be blocked if they send 4 or more emails, to 40
or more people, within a 5 minute period, or if they meet either of the
previously mentioned conditions.
Historically-- this has represented approximately 99% of the abuse we run
into on the web email system. Implementing this policy has almost
completely eliminated the ability for hackers to use a hijacked web mail
account to send spam.
For this reason, we do not recommend using webemail for more than casual
email distribution, and is technically a violation of our terms and
conditions.
Resale of RANGENET's networks and/or services is strictly forbidden
under all circumstances.
RANGENET prohibits reselling its services without expressed
written consent. This includes RANGENET's Web pages and Mail services.
RANGENET reserves the right to refuse service to anyone, and the right
to terminate any account at any time. Personal accounts are for student
or home entertainment purposes only. Personal accounts used for any other
reason may be suspended or terminated. All users of RANGENET are restricted
to one continuous hour of usage during prime time (6pm - 11pm). This means
one hour on and one hour off!
We ask that all users log off if idle for more than 15 minutes. This
keeps system load low, and improves availability of services to other customers.
User data may only be stored in the user's home directory. Usage of other
disk space is prohibited, except by RANGENET's system programs making
temporary use of the system's public temporary storage areas. A quota of
10 megabytes is allocated to each user. If disk quota is exceeded for more
than 7 days, a nominal fee of $2.50 per megabyte per month will be billed.
Bulk mailings of more than 100 users from RANGENET is prohibited.
Users sending letters with more than 5 recipients must run consecutive
mail delivery programs. Concurrent mailings to more than 5 recipients and
unsolicited commercial mail to multiple recipients are not allowed. An
individual dialup account entitles only the named user to log in.
RANGENET also offers dedicated connection and dedicated lines
for these purposes. These dedicated service accounts are not governed by
the above non-dedicated account usage policies, but ARE governed by ALL
other RANGENET terms and conditions. Other uses are considered
fraudulent. A charge equal to the monthly fee may be charged for commercial
activities within an individual dialup account.
Usnet Commercial posting to non-commercial newsgroups or postings which
are directed to either inappropriate, unrelated, or more than 20 groups
is prohibited. Groups in the RANGENET groups are not meant for posting
of other service providers.
PAYMENT OBLIGATIONS/TERMINATIONS:
Payment is due on the Due Date
on your invoice. If payment is not received within 45 days
of the due date, the account is in default and subject to suspension with
a $25 reactivation charge. Such interruption does not relieve you from paying
past due and ongoing charges. ONLY A WRITTEN REQUEST By E-mail or US Mail,
BY THE 25th OF THE MONTH PRIOR to the month you want to terminate Will RELIEVE
YOU OF YOUR OBLIGATION TO PAY FURTHER ACCOUNT CHARGES.
IT DOES NOT RELIEVE YOU OF PAST OBLIGATIONS
AND CHARGES. PREPAYED ACCOUNTS ARE NOT REFUNDABLE.
All invoices received are payable for the month received. Termination
must precede the billing process. Termination within the
first two (2) months of signing up is subject to a $25 Fee to cover our
expenses of setting up the account.
BAD CHECKS and RETURNED CHECKS:
There will be a
$25 (Twenty-Five dollar) handling fee on all returned checks.
If you default, you agree to pay RANGENET's reasonable expenses, including
attorney and collection fees, to enforce its rights under these Terms and
Conditions. Prepaid accounts are not refundable for any reason, including
termination and/or cancellation. If payment remains unpaid for 30 days a minimum finance charge of $1.00
and an interest fee of 1 1/2% per month on the past due outstanding
balance will be assessed at the annual percentage rate of 18% per annum.
These Terms and Conditions supersede all previous representations, understandings,
or agreements and shall prevail not with standing any variance with Terms
and Conditions of any other submitted use of RANGENET's services,
networks, and systems constitutes acceptance of the terms.
